You can access your personal information that we hold, except as provided for in the Act. To obtain access to your personal information please email office@invercargillcremations.co.nz requesting your personal information and confirming your identity and we will provide it to you. We reserve the right to charge a reasonable fee for the provision of this information. If we refuse your request, or if we refuse to give you access in the manner you requested, Invercargill Cremations policy is to provide you with written confirmation of the reasons for our refusal and the available complaint process. Complaints

If you have a complaint about how Invercargill Cremations has collected, stored or used your personal information, please contact us. We will endeavour to respond within five business days. If your complaint is unable to be resolved within five business days, Invercargill Cremations will advise you in writing including letting you know when we expect to provide our response. Funeral Authority Form

Terms and Conditions

Crematorium means the Invercargill City Council crematorium situated at Hawthorndale, Invercargill.

Customer means the customer named in this Agreement and if more than one then their liability shall be split equally across the debt and includes the term “you”.

Deceased means the deceased person named in this Agreement.

Services means all services, advice and attendances provided by Invercargill Cremations.

Invercargill Cremations means Invercargill Cremations ltd terms “we”, “us” or “our”.

1.0 Acceptance:

1.1 By signing this Agreement (this includes electronic signing) the Customer agrees to the terms of this Agreement. 

2.0 Services:

2.1 Invercargill Cremations agrees to provide the Services outlined in the quotation provided within the agreed timeframe. 

2.2 Payment for the Services must be received by Invercargill Cremations prior to commencement of the Services. Unless otherwise arranged. 

2.3 We shall provide our Services in accordance with current industry standard, skill and diligence and will endeavour to keep you informed of any issues that may arise. 

2.4 We shall be under no liability whatsoever to you for any indirect and/or consequential and/or expense suffered by you arising out of a breach by us of these terms and conditions, alternatively our liability shall be limited to damages, which shall not exceed the price of the Services. 

3.0 Privacy Policy:

3.1 You authorise us to collect personal information about you and the Deceased and that we will share that information with The Funeral Trust, relevant regulatory authorities, and others who assist us to provide its services including to recover fees and costs. 

Use that information to provide the Services; and comply with our obligations under the Privacy Act 2020 [and as set out in our privacy policy

You have a right of access to any information collected and to request corrections. 

4.0 Return of Ashes:

4.1 The ashes of the Deceased must be collected within three (3) days of cremation. You have to collect them from Invercargill Cremations. You must acknowledge this at time of engaging our services

4.2 If the ashes of the Deceased have not been claimed within one (1) month then the ashes of the Deceased may be scattered at an appropriate site. A registered letter will be sent to the last known address of the Customer prior to scattering. We accept no liability to the Customer should there be no response to the registered letter. 

5.0 Force Majeure:

5.1 Neither party will be liable for any loss or damage or delay, act or omission, or failure by it under this agreement which is caused by any circumstances beyond the reasonable control of that party (including without limitation, any act of God, act or regulation of any governmental authority, war or national emergency, accident, epidemic, pandemic, fire, riot, strike, lock-out or other form of industrial action) provided that: 

(a) We will endeavour to communicate such delay with you; and 

(b) We will use our best endeavours to complete our obligations pursuant to this Agreement. 

6.0 Disputes:

6.1 Any disputes arising out of this Agreement will be resolved in accordance with this clause. 

(a) If you have a problem with the services provided you must first contact us and advise us of the issue. If we are at fault we will endeavour to fix the issue as soon as possible. 

(b) If we cannot resolve the issue together then you will be free to utilise the complaints process of the Funeral Directors Association of New Zealand or through the courts.

I/we have received a copy of this Funeral Services Authority Agreement and acknowledge the content has been explained to me/us.
